1. Acceptance of Terms

By accessing or using the Hair HueTryOn platform ("Service"), you ("User") agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access or use the Service. These terms form a legally binding agreement between you and Yossef Ayman Zedan.

2. Intellectual Property

The platform, including its design, user interface, and proprietary features, is the intellectual property of Yossef Ayman Zedan. The functionality and operational methods utilized within the platform are protected by applicable copyright, trademark, and trade secret laws.

User-Uploaded Content & Generated Outputs:

• Ownership: Users retain full ownership of all images they upload to the platform.
• Generated Outputs: Users retain full ownership of all AI-generated outputs they receive.
• No Platform Claim: The platform does not claim ownership of user-uploaded images or generated outputs.
• Data Protection: Uploaded and generated images are stored securely for processing, quality control, and fraud prevention.
• Marketing Usage: Any use of user-uploaded images or generated outputs in marketing materials by Hair HueTryOn requires a separate, manual agreement made in person or through meetings with the user prior to their use of the service, ensuring full protection of user privacy.

3. Usage Restrictions

Users are prohibited from the following activities without prior written consent from Yossef Ayman Zedan:

1. Reverse engineering, disassembling, or extracting source code from the platform.
2. Using generated outputs for AI training, resale, or redistribution.
3. Creating datasets from generated outputs for any purpose, including research or development.
4. Bypassing security protocols or access controls.
5. Sharing platform access credentials or generated outputs with third parties.
6. Using automated bots, scripts, or mechanisms for unauthorized access.
7. Modifying, copying, or redistributing any platform-generated content.

4. Protection of Images & Copyright

The platform employs security measures such as watermarks and metadata embedding to prevent unauthorized use. The following restrictions apply:

• Unauthorized downloading, copying, or redistribution of images is strictly prohibited.
• Images may not be used for NFTs, AI training datasets, or derivative works without explicit written consent.
• Images must not be used to defame, harass, or mislead individuals or groups.

5. AI Bias & Accuracy Disclaimer

While Hair HueTryOn’s AI technology is designed to deliver high-accuracy results, it is subject to inherent limitations:

• Generated outputs may not always align with user expectations due to AI biases.
• The platform does not guarantee 100% accuracy or consistency in results.
• The virtual try-on tools are not always 100% accurate and may not fully reflect real-life outcomes.
• AI-generated outputs should not be relied upon for legal, medical, or critical decision-making purposes.
• Disclaimer: Yossef Ayman Zedan and Hair HueTryOn are not liable for damages or losses resulting from the use of AI-generated content.

6. AI Limitations on Short Hair and Specific Hair Conditions

The AI may not accurately process certain hair conditions, including but not limited to short hairstyles (e.g., buzz cuts), baldness, very short hair, or hair that lacks sufficient density (e.g., thinning or "fallen" hair). These limitations stem from inherent biases and constraints in the AI model, which may struggle to generate accurate or realistic outputs for such cases. Users are advised that results for these hair types or conditions may not meet standard output expectations and should not be relied upon for precise representation.

7. Suspicious Activity Monitoring

The platform actively monitors for suspicious activities to prevent abuse. Activities triggering security reviews include:

• Excessive image generation requests.
• Attempts to bypass the 1-second generation interval.
• Unusual login patterns or multiple account creation attempts.
• Use of unauthorized automated tools or bots.

8. User Responsibility

Users must ensure compliance with these Terms and Conditions at all times. Any unauthorized attempt to access, modify, or disrupt platform services will result in immediate termination of access. Images and roadmaps generated are the sole responsibility of the user, and Hair HueTryOn holds no liability for any damages or legal issues arising from their use.

9. Image Generation Limits & Waiting Time

To ensure platform stability, users must adhere to the following guidelines:

• Users must wait 1 second between each image generation request.
• Failure to comply may result in temporary suspension or permanent account termination.

10. Trial Accounts & Credit System

Trial accounts operate on a credit-based system where:

• 1 credit equals 1 generated image.
• Hair HueTryOn credits expire after 30 days from the date of issuance.
• Playground credits do not expire.
• If a bug prevents an image from being produced, the system automatically detects the failure and does not decrement the credit from the user's account.
• Users requiring additional credits must contact yossefaymanzedan@huetryon.com for approval.

11. Business & Enterprise Collaboration

Businesses interested in integrating or purchasing the AI technology can request additional credits after using their trial quota. For enterprise collaborations or custom AI solutions, contact yossefaymanzedan@huetryon.com. Hair HueTryOn may publicly acknowledge companies or salons utilizing our services unless otherwise requested by the business.

12. Hair HueTryOn Playground Usage

The Hair HueTryOn Playground is intended for individual use and for business customers to experiment with new colors, styles, and textures for potential integration into their own applications. The following terms apply:

• Playground outputs are for personal use or business evaluation only.
• Hair HueTryOn does not save or retain playground colors, styles, or textures created by users.
• Business customers cannot use playground outputs commercially without written consent from Yossef Ayman Zedan.

13. Pricing Changes

Hair HueTryOn reserves the right to modify the pricing of its services as improvements and enhancements are made to the platform. Users will be notified of significant price changes via email or through updates posted on the platform.

14. Data Ownership and Confidentiality

All data provided remains the intellectual property of Yossef Ayman Zedan. However, users retain ownership of their generated outputs. The platform will not share or commercialize user data without explicit consent, except when legally required.

15. Image Storage and Data Retention

Uploaded and generated images may be stored for security, fraud prevention, and quality control purposes. All files, including original user-uploaded images and AI-generated outputs, are automatically deleted one hour after the latest generation. Stored images will not be shared with third parties without user consent, except in cases of legal compliance.

16. Termination of Access

The platform reserves the right to terminate access at any time without notice for any violations of these Terms and Conditions, including creating more than one account per user and using free trial credits, which will result in all accounts being blocked.

17. Limitation of Liability

Hair HueTryOn and Yossef Ayman Zedan are not responsible for any harm, injury, or damages resulting from the use of any services provided by the platform, including but not limited to virtual try-on tools, generated images, or HueMate guidance.

18. Reporting Bugs and Errors

The platform may occasionally experience bugs or errors in results or processes. If a bug negatively affects you, please report it to yossefaymanzedan@huetryon.com, and Yossef Ayman Zedan will work to resolve the issue.

19. Updates to Terms

We reserve the right to update these Terms and Conditions at any time. Significant updates will be communicated via email or posted on the platform.

21. HueMate Guidance & Content Usage

HueMate is an AI-powered assistant integrated into the platform to guide users through hair dyeing processes, including product recommendations and step-by-step instructions. The following terms apply to all interactions with HueMate to ensure full protection of the platform and its owner, Yossef Ayman Zedan:

• Content Usage Restrictions:
  • HueMate-generated guidance, recommendations, and instructions ("Content") are provided exclusively for personal use or business evaluation within the scope of the Hair HueTryOn platform.
  • Commercial use, reproduction, distribution, or modification of HueMate-generated Content is strictly prohibited without prior written consent from Yossef Ayman Zedan.
  • Users may not use, sell, sublicense, lease, or distribute HueMate-generated Content to third parties without explicit authorization.
  • HueMate-generated Content may not be used to develop, train, enhance, or operate competing products, services, or applications.
  • Copying, scraping, reproducing, or creating derivative works from HueMate-generated Content is expressly forbidden.
• Ownership and Rights:
  • All HueMate-generated Content remains under the control and ownership of Yossef Ayman Zedan for as long as it is hosted on the Hair HueTryOn platform.
  • Users are granted a limited, non-exclusive, non-transferable, revocable license to use HueMate-generated Content solely for permitted purposes in accordance with these Terms and Conditions.
  • No rights or licenses are granted implicitly or otherwise to use HueMate-generated Content beyond the scope of these terms.
• Prohibited Uses:
  • Users shall not incorporate, embed, or otherwise use HueMate-generated Content in any AI training datasets or machine learning models.
  • Use of HueMate-generated Content in advertising, promotional materials, or any commercial media without explicit consent is prohibited.
  • HueMate-generated Content may not be used for unethical, harmful, misleading, or defamatory purposes.
  • HueMate-generated Content shall not be redistributed on third-party platforms, including but not limited to websites, applications, or social media channels.
• No Guarantee of Accuracy and Fitness for Purpose:
  • While HueMate aims to provide accurate and relevant information, the platform does not guarantee the completeness, accuracy, reliability, or fitness for any particular purpose of the generated Content.
  • HueMate-generated guidance should not be considered professional advice, and users should independently verify any recommendations before acting upon them.
  • The platform makes no warranties, express or implied, regarding the results of using HueMate-generated Content, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • HueMate Vision and HueMate VisionPro Analysis Disclaimer: The analysis and recommendations provided by HueMate Vision and HueMate VisionPro rely on AI-based interpretation of images and may contain errors, inaccuracies, or misinterpretations. Users should exercise discretion and verify results before making any decisions based on the analysis.
  • HueMate is limited to 128k tokens. When it reaches this limit, we kindly ask you to start a new chat.
• Limitation of Liability:
  • Yossef Ayman Zedan is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use of HueMate-generated Content.
  • This limitation of liability applies to damages caused by reliance on any information provided by HueMate, errors, inaccuracies, or omissions in the Content, and any other claims connected with the use of HueMate-generated Content.
  • Users acknowledge that the use of HueMate-generated Content is at their own risk, and Yossef Ayman Zedan shall not be responsible for any adverse outcomes related to such use.
• Monitoring and Enforcement:
  • The platform reserves the right to monitor usage of HueMate-generated Content and may take appropriate legal actions, including seeking damages, injunctions, or account termination for any unauthorized use.
  • Violations of these terms may result in the immediate suspension or termination of user access without notice and may be subject to further legal action.
• Indemnification:
  • Users agree to indemnify, defend, and hold harmless Yossef Ayman Zedan from and against any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or in any way connected with their use or misuse of HueMate-generated Content.
  • This indemnification obligation will survive the termination or expiration of these Terms and Conditions and user access to the platform.
• Confidentiality and Non-Disclosure:
  • HueMate-generated Content is considered confidential and proprietary. Users may not disclose, share, or make available such Content to any third party without prior written consent from Yossef Ayman Zedan.
  • Any unauthorized disclosure or use of HueMate-generated Content will be treated as a material breach of these Terms and Conditions and may result in legal action.

22. Refund Policy

Hair HueTryOn offers refunds under the following conditions:

• Refund requests must be submitted by contacting yossefaymanzedan@huetryon.com within three (3) days of the purchase date.
• Refunds are processed through PayPal. Please note that PayPal's refund fees may apply and could affect the final refund amount based on your location and the currency used during the payment process when subscribing to our service.
• After the three-day period, all sales are final, and no refunds will be issued.
